AN APPEAL FROM PROTECT OUR PARKS AND NEIGHBORHOODS (POPAN) "As you probably know, the Widewaters development proposal for Elmira Road opposite Buttermilk Falls State Park was recently given the green light by the City's Planning and Development Board. Despite vocal and carefully researched specific suggestions from many quarters to mitigate the impacts of this proposal, it was approved pretty much as submitted.

"As such, it will have a major impact on the viewshed of Buttermilk Falls State Park and on the Southwest Natural Area just behind it. One particularly outrageous feature of the approved plan is using the adjoining Southwest Natural Area to treat the runoff from the development, instead of treating it on-site. We believe that this use of public park land for a private, commercially-related purpose, in addition to seriously degrading the character of the natural area, is illegal.

"A LAWSUIT seeking to overturn Site Plan approval on the basis of this illegal use of the parkland (along with other irregularities) stands a reasonably good chance of success. But it will only happen if we can quickly raise the significant sum needed to retain a skilled attorney. You can help, if you will, both by contributing yourself and by recruiting others to do so."

[failure of the City to enact a Business Improvement District for Southwest development] "amounts to a 'sprawl tax' on everyone in Ithaca. The tax collected is a form of corporate welfare to companies like Lowe's or Home Depot, who get a large parcel of cheap land that is not properly serviced by the city, and which, in order to function, must come with improvements that the taxpayers (including other business that will suffer from the big box stores) have to pay.
---" If local residents plan to file a lawsuit against the city (and I hope they do), it would be good to have that known, because it might affect the thinking of a company like Target, which wants only to get into the ground and not have to wait another year while litigation plays out. Residents should make it clear they intend to take the city to court. I love the last quote from the Planning Board member about planned economy. Apparently he thinks he is sitting on the Federal Reserve Board.
